Terms of Use

Last updated: 26 October 2026

1. About these terms

This website is operated by Cloudtrader Limited, trading as CloudTrader, a company incorporated in Hong Kong. These terms govern your access to and use of our website.

By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please stop using it. If you use the website on behalf of an organisation, you must be authorised to do so.

These terms relate to the website only. Any services we provide are subject to a separate written agreement. If that agreement conflicts with these terms in relation to the services, the agreement takes priority.

2. Website information and service enquiries

The website describes our technology, advisory and programme services for general business information. Its content is not advice tailored to your circumstances and should not be relied on as a substitute for a specific assessment or appropriate professional advice.

Descriptions of services are not a binding offer, a commitment to accept an engagement or a guarantee of any particular outcome. The scope, fees, responsibilities and deliverables of an engagement must be agreed separately in writing. Sending us an email does not, by itself, establish a client relationship.

Where a proposed engagement involves third-party partners, its availability, eligibility requirements, approvals and commercial terms depend on the relevant partners, jurisdiction and agreed arrangements. The company disclosure in the footer explains the respective roles.

3. Permitted use

You may browse the website and download or print reasonable extracts for your own internal business evaluation or personal reference, provided you retain relevant copyright and ownership notices.

You must use the website lawfully and must not:

  • Attempt to obtain unauthorised access to the website, its systems or information.
  • Introduce malicious code, disrupt the website or interfere with another person's use of it.
  • Use automated tools to extract content in a way that circumvents access restrictions or materially burdens the website.
  • Misrepresent your identity, impersonate another person or imply an affiliation or endorsement that does not exist.
  • Use website content in a misleading way or infringe the rights of us or any third party.

We may restrict access where reasonably necessary to protect the website, address misuse or comply with law.

4. Intellectual property

Unless otherwise stated, the website's text, branding, design and other materials are owned by us or used with permission from their respective owners. They are protected by applicable intellectual property laws.

Except for the limited use permitted above, or as otherwise allowed by law, you may not reproduce, modify, distribute, republish or commercially exploit website content without the relevant owner's prior permission. These terms do not transfer ownership of any intellectual property or grant a right to use our name or logo to suggest endorsement.

Third-party materials and marks remain the property of their respective owners. If you believe material on this website infringes your rights, please contact us with details of the material and your claim.

5. Accuracy and availability

We take reasonable care in preparing the website, but information may become outdated or contain errors or omissions. Please contact us to confirm any information material to a business decision.

To the extent permitted by law, we do not warrant that the website or its content will always be accurate, complete, current, uninterrupted or free from errors or harmful code. We may update, suspend or withdraw all or part of the website for maintenance, security, operational or legal reasons.

You are responsible for using appropriate device security and for assessing whether website information is suitable for your purposes.

6. Third-party websites and services

Links to third-party websites or references to external services are provided for convenience or context. Unless expressly stated, they do not amount to an endorsement or a representation that we control those providers.

External websites and services have their own terms and privacy policies. You should review those before using them. To the extent permitted by law, we are not responsible for their content, availability or practices.

7. Email communications and privacy

Enquiries should be sent to contact@cloudtraderhk.com. Please provide only information relevant to your enquiry and do not send passwords, identity documents or other sensitive information in an initial email.

Ordinary email is not guaranteed to be secure. Before sharing confidential business material, please contact us to agree an appropriate sharing method and, where needed, confidentiality arrangements. An unsolicited email does not by itself create an agreed confidentiality obligation; any applicable legal duties remain unaffected.

Our Privacy Notice explains how we handle personal data associated with website use and enquiries. These terms do not waive your statutory privacy rights.

8. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability or right that cannot lawfully be excluded or limited.

Subject to that protection and only to the extent permitted by applicable law, we exclude liability for indirect or consequential loss arising from your use of, or inability to use, the website or reliance on its general information. This may include loss of profit, revenue, business opportunity or data where that loss is indirect or consequential.

Any exclusion or limitation applies only where lawful and, where required by Hong Kong's Control of Exemption Clauses Ordinance (Cap. 71), reasonable. These terms do not exclude mandatory statutory rights or remedies. Liability relating to an agreed service engagement is governed by the relevant agreement and applicable law, not this website clause.

9. Changes to these terms

We may revise these terms to reflect changes to the website, our practices or applicable law. The latest version will be published on this page with its update date.

Changes apply to use of the website after they are published and do not retrospectively change an existing service agreement. Please review this page when you return to the website.

10. General provisions

If a provision is held to be unlawful or unenforceable, it will apply only to the extent that it is lawful and enforceable, and the remaining provisions will continue to apply. A delay or failure to exercise a right does not by itself waive that right.

Unless expressly stated otherwise, a person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce them. This does not affect any independent right or remedy available under applicable law.

11. Governing law and disputes

These terms are governed by the laws of Hong Kong. Subject to any mandatory rights or jurisdiction rules that apply, the courts of Hong Kong have non-exclusive jurisdiction over disputes relating to these terms or use of the website.

If you have a concern about the website, please contact us first so we can try to resolve it. This does not restrict your right to seek a remedy available under law.
